Tax on Dubai Property: Individuals, Companies and the 2026 Rules

· October 2026 · 6 min read

International owners often arrive in Dubai expecting the tax question to be complicated, and for most of them it is the opposite. An individual who owns Dubai residential property in a personal name pays nothing on the rent it earns or on a later sale. The position changes the moment the property sits inside a company, and a company based abroad usually cannot hold Dubai property in its own name at all. Much of what is written online blurs these cases into one.

Does an individual pay tax on rental income from Dubai property?

In almost every case, no. The UAE levies no personal income tax, and income a natural person earns from investing in UAE real estate is placed outside corporate tax as well, regardless of how much rent it produces, provided the activity does not require a licence. Source: Cabinet Decision No. 49 of 2023; Federal Tax Authority guide on real estate investment for natural persons, October 2024.

Corporate tax runs at 9 per cent on taxable income above AED 375,000, and at nothing below that figure. A natural person is drawn into it only through a business, and the AED 1 million annual turnover test that defines when a business becomes taxable excludes real estate investment income entirely, so the size of a personal property portfolio does not by itself trigger a charge. Source: Federal Decree-Law No. 47 of 2022, Article 3; Cabinet Decision No. 49 of 2023.

What about the profit when the property is sold?

That is also untaxed when the owner is an individual holding in a personal name. The UAE has no capital gains tax on individuals, and the definition that keeps personal rental income outside corporate tax covers the sale, leasing and renting of the property alike, so a gain on disposal is not charged either. Source: Cabinet Decision No. 49 of 2023; Federal Tax Authority guide on real estate investment for natural persons, October 2024.

When does a licence change the answer?

When the way the property is used requires one. The exclusion for a natural person depends on the activity not being conducted through, and not requiring, a licence from a licensing authority. Letting a home on short stays as a holiday rental requires a permit from Dubai's Department of Economy and Tourism, and that permit counts as a licence, so the income it produces is treated as business income rather than exempt investment income. A standard residential tenancy does not cross that line. Registering a lease on Ejari is an administrative record, not a licence, and using a licensed rental agent does not disqualify the owner, provided the owner holds no licence personally. Where the exclusion is lost, the ordinary rules return: the AED 1 million turnover test decides whether registration is required, and corporate tax then applies at 9 per cent above AED 375,000. In practice a single holiday home rarely produces turnover at that level, so for most individual owners the permit changes the scope of the rules rather than producing a tax that is actually paid. Does holding through a company change the position?

Yes, and this is where international owners are most often caught out. A company is a taxable person in its own right, so rental profit and gains it makes on Dubai property fall within corporate tax and are charged at 9 per cent on taxable income above AED 375,000, whatever the treatment would have been had the same individual held the property directly. Source: Federal Decree-Law No. 47 of 2022, Article 3.

A holding structure is frequently chosen for succession or privacy rather than for tax, and it can still be the right answer for those reasons. The point is only that the tax treatment is not the same as personal ownership, so it should be priced in before the structure is created rather than discovered afterwards. How ownership and succession interact is set out in the note on Dubai property and inheritance.

Can a company based abroad own Dubai property?

Not directly, as a rule. A company incorporated outside the UAE cannot usually be registered on a Dubai freehold title in its own name. The Dubai Land Department requires the registered owner to be an entity it recognises, so a foreign buyer who holds through a company normally does so through a UAE vehicle, most commonly a Jebel Ali Free Zone offshore company, with the foreign parent held above it as shareholder. Source: Dubai Land Department, corporate buyer registration requirement; the accepted vehicles are confirmed by the DLD case by case.

Whichever recognised vehicle holds the property, it is a taxable person in its own right, so its rental profit and its gains are charged to corporate tax at 9 per cent on taxable income above AED 375,000, exactly as for any company. Source: Federal Decree-Law No. 47 of 2022, Article 3.

The tax net also reaches a non-resident company directly where one does earn income from UAE property. For tax periods beginning on or after 1 January 2025, such a company is treated as having a nexus in the UAE on that income, whether from letting, from sale or from other use, so placing an offshore layer above the asset does not move Dubai property income outside the UAE net. Source: Cabinet Decision No. 35 of 2025, Articles 2 and 7.

Is any VAT charged on residential property?

Generally not on homes. The lease and the resale of residential property are exempt from VAT, and the first sale of a newly built residential property within three years of its completion is zero-rated, so a residential owner does not add VAT to rent or to a sale. Commercial property is treated differently, and the Land Department transfer fee on a purchase is a separate charge, not a tax on income. Source: Federal Decree-Law No. 8 of 2017 on VAT; Cabinet Decision No. 52 of 2017, the Executive Regulation.

The fees that do fall due on a purchase, rather than on ownership, are set out in the reference on Dubai property purchase costs.

What should an international owner check?

Whether each property is held personally or through a company, and whether that choice was made for tax, for succession or for privacy. Whether any part of the portfolio is let on short stays under a tourism permit, which changes the treatment. And, most often overlooked, whether the owner's home country taxes worldwide income or gains, because a residence rule, a remittance rule or a controlled-foreign-company rule abroad can reach Dubai property income that the UAE itself leaves alone.

Ownership also interacts with residency, since a property that supports a Golden Visa is valued on its certified figure rather than its tax position; see the UAE Golden Visa through property. How XLCR approaches ownership and the questions that sit around it is set out under what XLCR does.

Frequently asked questions

Do you pay tax on rental income in Dubai?

For an individual who owns the property in a personal name, no. The UAE has no personal income tax, and a natural person's income from investing in UAE real estate sits outside corporate tax as well, regardless of the amount, as long as the activity does not require a licence. Source: Cabinet Decision No. 49 of 2023 and the Federal Tax Authority guide on real estate investment for natural persons, October 2024.

Is there capital gains tax on selling property in Dubai?

The UAE does not levy capital gains tax on individuals. Where a person holds Dubai property in a personal name, the gain on a sale is treated the same way as rental income and falls outside corporate tax, so the profit on disposal is not charged. A company that owns the property is treated differently. Source: Cabinet Decision No. 49 of 2023 and Federal Decree-Law No. 47 of 2022.

Does the UAE have personal income tax?

No. The UAE does not impose any tax on the salaries or personal income of individuals, and there are no current plans to introduce one. Corporate tax, which applies to financial years from mid 2023, is charged on businesses and companies rather than on individuals earning personal income, which is why personally held rental income is not taxed. Source: Federal Decree-Law No. 47 of 2022 on corporate tax.

Do you pay corporate tax if you own Dubai property through a company?

Yes. A company is a taxable person, so rental profit and gains it makes on Dubai property fall within UAE corporate tax and are charged at 9 per cent on taxable income above AED 375,000. This applies even where the same person, holding the property personally, would not have been taxed at all. Source: Federal Decree-Law No. 47 of 2022, Article 3.

Are short-term holiday rentals in Dubai taxed differently?

Only once the income is large enough. A holiday let that needs a permit from Dubai's Department of Economy and Tourism is a licensed activity, so it counts as business income rather than exempt investment income. Corporate tax is then charged only if the owner's business turnover passes AED 1 million in the year, and only on profit above AED 375,000, so a single holiday home usually produces no tax at all. Source: Cabinet Decision No. 49 of 2023 and the Federal Tax Authority guide on real estate investment for natural persons, October 2024.

Can a foreign company own Dubai property, and is it taxed?

A company incorporated abroad usually cannot be registered on a Dubai freehold title directly, so property is typically held through a recognised UAE vehicle, which is itself a taxable person. Where a non-resident company does earn income from UAE property, it is treated as having a UAE nexus on that income for tax periods beginning on or after 1 January 2025. Source: Cabinet Decision No. 35 of 2025, Articles 2 and 7, and Dubai Land Department registration requirements.
